This Privacy Policy explains how Wellbee App, LLC (“Wellbee”, “we”, “us”, or “our”) collects, uses, and discloses information about you when you access or use our mobile applications, websites, and other online products and services (collectively, the “Services”), and when you contact our customer service team, engage with us on social media, or otherwise interact with us.

Before using the Services or submitting any Personal Information to Wellbee, please review this Privacy Policy carefully and contact us if you have any questions. By using the Services, you expressly consent to Wellbee’s collection, use, maintenance and disclosure of your Personal Information in accordance with the practices described in this Privacy Policy. If you do not agree to this Privacy Policy, please do not access or use the Services.

Note to Residents of the European Union, United Kingdom, and Switzerland: In order to comply with the requirements of the European General Data Protection Regulation (GDPR) and other applicable data protection laws for our international users, this Privacy Policy outlines the legal bases on which we process your Personal Information and provides other information required by applicable law.

Privacy Principles

If you read nothing else, please read this:

  • Information about your health, wellness, fitness, diet, and personal habits is private. We understand the responsibility of protecting the privacy and security of this information and will do our best to uphold this commitment.

  • We collect information on your usage of our Services to improve the app. This policy is not intended to place any limits on what we do with usage data that is aggregated or de-identified so it is no longer tied to a Wellbee user.

  • We do not sell your personal information to third parties for any purpose.

Personal Information We Collect

The categories of personal information we collect depend on how you use our Services and the requirements of applicable law. We collect information that you provide to us, information we obtain automatically when you use our Services, and information from other sources such as third-party services and organizations, as described below.

Information You Provide to Us

You provide us information about yourself when you register for and/or use the Services. The information you may provide includes:

  • Account Information: Name, email address, age, gender, and account preferences

  • Health and Wellness Data: Physical characteristics (including height, weight, areas for improvement), fitness level, health goals, wellness preferences

  • Activity Data: Food preferences, meals and exercises you log, wellness activities, progress tracking data

  • Content: Photos you take or upload for profile avatars, AI instructions (text or pictures you input as AI prompts), responses to our conversations and assessments

  • Communication Data: Information you provide when you contact us with problems or questions

Information Collected Automatically

We may collect personal information automatically when you use our Services:

  • Device Information: Internet protocol (IP) address, user settings, MAC address, cookie identifiers, mobile carrier, mobile advertising and other unique identifiers, browser or device information, general location information (including approximate location derived from IP address and time zone), Internet service provider, device type, operating system, device settings, device identifiers, and crash data

  • Usage Analytics: Information about how you use our Services, including actions performed, features accessed, session duration, and other usage patterns

  • Cookies and Tracking Technologies: We use cookies, web beacons, and similar tracking technologies to collect information about your interactions with our Services

HealthKit and Health App Integration

For iOS Apps: If you use our Services on an iOS device, we may collect data from the iOS Health app and/or HealthKit, including date of birth, height, sex, weight, heart rate, sleep data, respiratory data, blood oxygen levels, and workout information (collectively, “HealthKit Information”). This data is covered by this Privacy Policy and will only be collected if you choose to provide it. Users are not required to share this information and may opt out by not granting permission when prompted.

For Android Apps: If you use our Services on an Android device, we may collect similar health and fitness data from Google Fit or other health platforms you choose to connect, subject to the same privacy protections as HealthKit data.

Information We Collect from Other Sources

We also obtain information about you from other sources, including:

  • Transaction information from third-party app stores you use to install our app or purchase subscriptions

  • Name and contact information from third-party calendar or fitness services you choose to connect

  • Information from social media services if you create or log into your account through such services

  • Information from publicly available sources, marketing and advertising partners, consumer research platforms, and business contact databases

How We Use Your Information

We may use your information for the following purposes:

Provide Our Services

We use your information to fulfill our contract with you and provide you with our Services, such as:

  • Managing your information and accounts

  • Providing access to certain areas, functionalities, and features of our Services

  • Using health and wellness information to help generate personalized plans and recommendations

  • Providing customer and technical support

  • Communicating with you about your account, activities, and policy changes

  • Processing job applications if you apply for positions we post

  • De-identified and Aggregated Information: To create de-identified and aggregated information for research and analysis purposes

How We Disclose Your Information

Wellbee does not sell your Personal Information. In certain circumstances we disclose your information to third parties for business purposes, including to provide our Services, protect us or others, or in the event of a major business transaction, as described below.

Service Providers and Vendors

We may share Personal Information with vendors and service providers who assist us in meeting business operations needs, including:

  • IT support and hosting services

  • Payment processing

  • Customer service

  • Analytics and research services

  • Marketing and advertising platforms

We take commercially reasonable steps to ensure our service providers adhere to appropriate security standards and use your information only as instructed by us.

Business Transfers

Health Apps and Platforms

You may choose to share your health data with other health apps and platforms through our Services. We will not share health data with advertising partners under any circumstances.

Advertising Partners

We may share limited personal information with third-party advertising partners for personalized advertising purposes. However, we do not share health and fitness data with advertising partners.

Special Note on Health and Fitness Data

Health and fitness data collected through our Services, including data from HealthKit, Google Fit, or other health platforms, will only be used for providing health, wellness, and fitness services in connection with our apps.

This data may be used to:

  • Help you review and track your health and wellness progress

  • Optimize personalized plans and recommendations

  • Provide insights and analytics within our Services

We will not disclose health and fitness information to any third party without your prior express consent, and then only for the purpose of providing health, wellness, and fitness services. Health data will not be used for marketing, advertising, or use-based data mining, including by third parties.

How You Can Exercise Your Privacy Rights

To maintain control of your personal data, you have the following rights:

General Rights

  • Access/Review/Update: You can review, edit, or update your personal information through your account settings or by contacting us

  • Delete: You can request deletion of your personal information, subject to certain legal limitations

  • Object/Restrict: You can ask us to stop using or limit our use of your personal information

  • Portability: You can request a copy of your personal information in a machine-readable format

Additional Rights for EEA, UK, and Switzerland Residents

If you are located in the European Economic Area, United Kingdom, or Switzerland, you have additional rights including:

  • The right to lodge a complaint with a supervisory authority

  • The right to withdraw consent where processing is based on consent

  • The right to object to processing based on legitimate interests

Rights for California Residents

If you are a California resident, you have rights under the California Consumer Privacy Act (CCPA) including:

  • The right to know what personal information we collect and how we use it

  • The right to delete personal information

  • The right to opt-out of any sales (though we do not sell personal information)

  • The right to non-discrimination for exercising your privacy rights

Age Limitations

Our Services are not intended for children under the age of 13. We do not knowingly collect or solicit personal information from children under 13. If you are under 13, please do not use our Services or provide any personal information. If we learn that we have collected personal information from a child under 13 without verification of parental consent, we will delete that information as quickly as possible. Data Security

We implement commercially reasonable safeguards to protect the integrity and security of your information. However, no system is 100% secure, and we cannot guarantee the security of any information you provide to us. We have implemented appropriate safeguards and require our third-party service providers to maintain similar protections.

By using our Services, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues. If we learn of a security breach, we may attempt to notify you electronically through our Services, by email, or by other means.

Data Retention

We retain Personal Information for as long as reasonably necessary for the purposes described in this Privacy Policy, while we have a legitimate business need to do so, or as required by law (including for tax, legal, accounting, or other purposes), whichever is longer.

You may delete your account directly through app settings or by contacting us. Upon a deletion request, we will permanently delete your personal information from our active systems, subject to certain legal retention requirements.

International Data Transfers

We may transfer personal data to countries other than the country in which the data was originally collected to provide our Services and for the purposes described in this Privacy Policy. If these countries do not have the same data protection laws as your country, we implement appropriate safeguards to protect your information.

Changes to This Privacy Policy

If we make changes, we will notify you by revising the date at the top of the policy and, in some cases, provide additional notice (such as adding a statement to our app or sending you an email notification). If you continue to use our Services after the updated Privacy Policy takes effect, you will be deemed to have accepted the updated policy.
